Terms and Conditions of JobSnap

These Terms govern your use of JobSnap and any related agreements or legal relationships with the Owner in a legally binding way. Capitalized words are defined in the “Definitions and Legal References” section below. Please read this document carefully.

Where JobSnap is provided via the Apple App Store, Google Play, or other third-party platforms, those providers may enforce these Terms as third-party beneficiaries. Nothing in these Terms creates an employment, agency, or partnership relationship between the parties.

“JobSnap” refers to:

  • The mobile application, website (including subdomains), and any other digital platforms where the Owner makes the Service available;
  • Application Program Interfaces (APIs);
  • The Service itself;
  • Any software, content, or documentation included as part of the Service.

 

What You Should Know at a Glance

  • Age Restriction: Users must be adults under applicable law (e.g., 18 in the U.S.) or use JobSnap under parental/adult supervision if minors.
  • Consumer Rights: The right of withdrawal/cancellation applies only to Consumers in certain jurisdictions (e.g., EU, UK, Brazil).
  • Service Scope: JobSnap connects customers and service providers using social validation and algorithmic optimization, as detailed below.

 

TERMS OF USE

General Conditions

Unless otherwise specified, these terms apply to all Users of JobSnap. Additional conditions may apply in specific scenarios and will be indicated within this document.

By using JobSnap, you confirm you meet these requirements:

  • No distinction applies between Consumers and Business Users unless stated;
  • You are an adult under applicable law, or a minor supervised by a parent/adult;
  • You are not in a country subject to a U.S. Government embargo or designated as ‘terrorist-supporting’;
  • You are not on any U.S. Government list of prohibited/restricted parties;
  • Service Providers: You must provide explicit consent prior to undergoing and must pass a background check conducted via Checkr to be eligible to offer services

 

Account Registration

To use the Service, you must register an account, providing complete and truthful information. Failure to do so may render the Service unavailable.

Credentials: You are responsible for keeping login credentials confidential and secure, using strong passwords as permitted by JobSnap.

Responsibility: You are fully liable for activities under your account and must notify us immediately at support@hellojobsnap.com if you suspect unauthorized access or data breaches.

Conditions for Registration:

  • No bots or automated methods may register accounts.
  • Each User may register only one account unless expressly permitted.
  • Accounts may not be shared with others unless specified.
  • Service Providers: You must provide accurate data required for background checks (e.g., name, date of birth, Social Security Number if provided voluntarily, etc.) and explicit consent for Checkr to process this data. Failure to comply may result in account denial or suspension.

Account Termination:

You may terminate your account via JobSnap’s settings or by contacting us, subject to any subscription terms below.

Account Suspension/Deletion:

We reserve the right to suspend or delete accounts deemed inappropriate, offensive, or in violation of these Terms, at our sole discretion, without notice. This does not entitle you to compensation, damages, or reimbursement, nor does it waive applicable fees owed.

Content on JobSnap

Unless stated otherwise, content on JobSnap is owned or licensed by the Owner. We strive to ensure content complies with laws and third-party rights, but this may not always be achievable. Report issues to cjones+redleaf@tcgsi.com.

Rights to Content:

All intellectual property rights are reserved. You may not copy, modify, distribute, or create derivative works from JobSnap content beyond what is necessary for Service use, unless expressly permitted. Statutory copyright exceptions remain unaffected.

User-Provided Content

You may upload content (e.g., service requests “Snaps,” ratings, social media links) to JobSnap.

Rights Granted: By uploading, you grant us a non-exclusive, royalty-free, worldwide license to process this content for JobSnap’s operation (e.g., matching, validation, optimization), waiving moral rights where permitted.

Liability: You are solely responsible for your content. We do not pre-filter content but may remove/block it if it violates these Terms, infringes rights, poses risks, or upon legal order, without notice. You indemnify us against claims arising from your content.

Removal via App Store:

Objectionable content reported via app stores will be removed within 24 hours, and the uploading User may be barred.

Access to External Resources

JobSnap may link to third-party resources (e.g., social media platforms, background check services by Checkr). We are not responsible for their content or availability. Use them at your own risk; their terms apply, including Checkr’s terms for background screening (available at [Checkr Terms URL])

DMCA Takedown Notices

Copyright holders may submit DMCA notices to support@hellojobsnap.com with:

  • Authorized signature;
  • Identification of infringed work and infringing material;
  • Contact info;
  • Good-faith belief and accuracy statements under penalty of perjury.

Non-compliant notices may be invalid.

Acceptable Use

Use JobSnap only as intended—connecting customers and providers—and in compliance with laws and rights. We may deny access, terminate agreements, or report misconduct if you:

  • Violate laws or these Terms;
  • Infringe rights;
  • Harm our interests;
  • Offend others.
  • Submit false or misleading data for background checks

“Tell-a-Friend” Program

You may earn benefits (e.g., subscription discounts) by referring new Users who subscribe. Details are in JobSnap’s referral section. We may end this program anytime.

Software License

We grant you a revocable, non-exclusive, non-sublicensable, non-transferable license to use JobSnap software for its intended purpose.

Scope: No source code access; all techniques remain ours or our licensors’.

Devices: Use on unlimited devices, but not simultaneously on multiple devices unless permitted.

Updates: You may need to install updates to continue use; new versions may require separate licenses.

Termination: License ends with account termination; delete all copies thereafter.

API Usage

API access is subject to these Terms. We are not liable for damages from API use or third-party products accessing JobSnap via API.

TERMS AND CONDITIONS OF SALE

Paid Products

JobSnap offers subscription-based access to its Service. Fees, duration, and conditions are below and in JobSnap’s dedicated sections.

Product Description

The Service connects customers and providers via a mobile app, using social validation and algorithmic optimization. Details (e.g., pricing, features) are in JobSnap and subject to change. Representations are for reference only; specifics are confirmed during purchase.

Order Submission

Contract Formation: Submitting an order (e.g., subscription) binds you to pay the listed price and fees.

Cooperation: You must provide accurate data (e.g., service request details).

Confirmation: You will receive an SMS receipt to your provided number.

Prices

Prices are displayed during purchase, inclusive or exclusive of taxes/fees as indicated. 

Subscription tiers are detailed in JobSnap.

Payment Methods

Accepted methods (e.g., credit card, Apple Pay) are shown during purchase.

Direct Management: We process and store payment data securely (see Privacy Policy).

Third-Party Providers: For third-party methods, we receive only payment confirmation, not card details.

Failed Payments: We may suspend Service and claim costs if payment fails.

Purchase via App Stores

App store purchases follow their terms, prevailing over these Terms if conflicting. Review them carefully.

Retention of Usage Rights

Service access begins once payment is received.

Delivery

Digital Service: Access is immediate upon payment via app download or account activation. Contact us if issues arise.

Performance of Services

Service is available as specified in JobSnap or communicated pre-order.

Contract Duration

Trial Period:

  • Free, limited trials may be offered, with some features restricted. Details are in JobSnap. Trials convert to paid subscriptions unless canceled beforehand.

Subscriptions:

  • Start: Begins upon payment receipt.
  • Renewal: Auto-renews unless canceled 24 hours before the period ends.
  • Payment: Recurring fees must be paid timely to avoid interruptions.
  • Apple ID Subscriptions: Managed via Apple App Store; payments charged 24 hours before renewal.

Termination:

Cancel via JobSnap controls or by emailing us. Open-ended subscriptions end 30 days after notice receipt.

USER RIGHTS

Right of Withdrawal (EU Consumers)

EU Consumers may withdraw within 14 days of contract start (digital content) for any reason, unless waived.

How: Notify us unequivocally at cjones+redleaf@tcgsi.com or use the model form in “Definitions.”

Effect: Full refund within 14 days via original payment method, excluding extra delivery costs.

Right to Cancel (UK Consumers)

UK Consumers have a 14-day cancellation right, subject to Seller terms if applicable via JobSnap.

Right of Regret (Brazilian Consumers)

Brazilian Consumers may withdraw within 7 days of contract start or service receipt, subject to Seller terms if applicable.

Guarantees (Brazilian Consumers)

Services have a 30-day (non-durable) or 90-day (durable) guarantee from performance end, per Brazilian law. Misuse voids this; contact us to claim.

LIABILITY AND INDEMNIFICATION

Indemnification

You indemnify us against claims from your use, violations, or content, including legal fees, to the extent permitted by law.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OWNER AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, CO-BRANDERS, PARTNERS, SUPPLIERS, AND EMPLOYEES BE LIABLE FOR:

  • ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICE;
  • ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR USER ACCOUNT OR THE INFORMATION CONTAINED THEREIN;
  • ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT;
  • PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE WHATSOEVER RESULTING FROM USER ACCESS TO OR USE OF THE SERVICE;
  • ANY UNAUTHORIZED ACCESS TO OR USE OF THE OWNER’S SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN;
  • ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE;
  • ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE;
  • ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE;
  • THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY USER OR THIRD PARTY;
  • ANY ERRORS, INACCURACIES, OR OMISSIONS IN BACKGROUND CHECK DATA PROVIDED BY CHECKR, WHICH WE RELY ON IN GOOD FAITH.

For US Users Specifically: JobSnap is provided strictly on an ‘as is’ and ‘as available’ basis. Use of the Service is at your own risk. To the maximum extent permitted by applicable law, the Owner expressly disclaims all conditions, representations, and warranties—whether express, implied, statutory, or otherwise—including but not limited to any implied warranty of merchantability, fitness for a particular purpose, or non-infringement of third-party rights. No advice or information obtained from the Owner or through the Service will create any warranty not expressly stated herein. We do not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free, or that it is free of viruses or harmful components.

IN NO EVENT SHALL THE OWNER AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, CO-BRANDERS, PARTNERS, SUPPLIERS, AND EMPLOYEES BE LIABLE FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES, OR COSTS IN AN AMOUNT EXCEEDING THE AMOUNT PAID BY USER TO THE OWNER HEREUNDER IN THE PRECEDING 12 MONTHS OR THE PERIOD OF DURATION OF THIS AGREEMENT BETWEEN THE OWNER AND USER, WHICHEVER IS SHORTER.

THIS LIMITATION OF LIABILITY SECTION SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION, WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF THE USER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; therefore, the above limitations or exclusions may not apply to the User. The terms give User specific legal rights, and User may also have other rights which vary from jurisdiction to jurisdiction. The disclaimers, exclusions, and limitations of liability under the terms shall not apply to the extent prohibited by applicable law.

Australian Users

Liability for non-excludable rights (e.g., under CCA) is limited to re-performance or cost reimbursement.

US Users

“As Is” Disclaimer: No warranties beyond what is stated; use at your risk. We do not guarantee uninterrupted service or third-party offerings.

Liability Cap: Limited to payments received in the prior 12 months or contract term, excluding indirect damages unless law prohibits.

COMMON PROVISIONS

No Waiver

Failure to enforce rights is not a waiver.

Service Interruption

We may interrupt Service for updates/maintenance or discontinue it, assisting with data withdrawal if ended.

Service Reselling

No resale without written permission.

Privacy Policy

Intellectual Property Rights

All IP in JobSnap is ours or our licensors’, protected by law.

Changes to Terms

We may amend Terms, notifying you via JobSnap or email. Continued use post-change implies acceptance. Prior versions are available upon request.

Assignment

We may assign rights; you may not without our consent.

Contacts

Severability

Invalid provisions do not affect others; we will replace them amicably or per law.

Governing Law

Delaware law governs, except where higher consumer standards apply.

Dispute Resolution

Arbitration in New York, NY via JAMS Streamlined Rules, waiving jury trials/class actions, except for EU/UK/Brazil Consumers who retain local jurisdiction rights.

  • Service: Matching customers and providers via app, social validation, and optimization.
  • User: Any individual/entity using JobSnap.
  • Consumer: A User qualifying as such under law.
  • Personal Data: Info identifying a person.
  • Usage Data: Automatically collected interaction data.
  • Model Withdrawal Form: “I hereby withdraw from the contract entered into on [date] for [service]. [Name, Address, Email].”
